Deshalb bedarf es einen gesetzlichen Ordnungsrahmen fur die Funktionsfahigkeit des Wettbewerbs und die Verwendung oeffentlicher Mittel. Aufgrund des sogenannten Kaskadenmodells (individuelle Konstruktion des deutschen Vergaberechts) ist auch in der VOB/A die Vergabe oeffentlicher Bauauftrage nicht umfassend geregelt. Zusatzlich zu beachten sind bundes- und landesgesetzliche Regelungen.
